Morse v. Frederick; or: Bong Hits 4 Jesus.

Morse v. Frederick asks the justices to weigh the court’s famous 1969 ruling that students do not “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate” against more recent decisions acknowledging a school system’s ability to create rules that maintain order and protect students from messages deemed harmful.

I remember hearing about this kid back in 2002, when the event made the news. I hadn’t heard anything about it since—and certainly didn’t realize that the principal had appealed to the Supreme Court. It’s an interesting case for sure—the Supreme Court’s past findings seem to side with the kid, but lower court decisions in the years since side with the principal. It will be interesting to see how our new conservative “strict constructionist” jurists side in this case. Will we see Scalia writing an opinion for an 18-year-old hippie because of his strict interpretation of the first amendment? Tasty.

    Maybe the kid should claim he left off part of the sign. It should have said, “Bong Hits 4, Jesus 9.”

    This was new to me. The slogan being nonsense makes the case more interesting, Ken Starr is so… still Ken Starr:
    “student free speech rights . . . appropriately yield when it comes to promoting illegal substances.”
